What to know
How it usually works
Probate is the court process that confirms a will (if there is one) and gives someone authority to handle the estate. In Texas, how a sale works depends on the kind of administration. An independent executor can often sell without going back to the court, while a dependent administration usually needs the court to approve the sale. Sometimes a will is probated as a muniment of title, which lets property pass to the people named in the will without a full administration.
- Find out where the estate stands. Has an application been filed? Has someone been appointed executor or administrator? Ask the estate's attorney if there is one.
- Confirm who can sign. The executor or administrator, the heirs, or the people named in the will. The title company will tell you exactly whose signatures it needs.
- Get a written offer. We give a clear offer the executor can review with the estate's attorney and the other beneficiaries.
- Close on the estate's timeline. If the court has to approve the sale, we wait for that. Taxes and debts the title company finds are normally paid from the sale at closing.
Questions
Common questions
Can land be sold before probate is finished?
Sometimes. It depends on the type of administration and the will. An independent executor can often sell during administration; a dependent administration usually needs court approval. The estate's attorney can tell you which applies.
What is a muniment of title?
It's a way to probate a will in Texas that lets property pass to the people named in the will without a full administration. Title companies often accept it to transfer land.
Is there a deadline to probate a will in Texas?
Generally a will should be offered for probate within four years of death. After that, options narrow. If it's been a while, talk to a Texas probate attorney.
Who pays the estate's debts and the back taxes?
Property taxes and liens on the land are normally paid from the sale at closing through the title company. Other estate debts are handled through the probate process.
