What to know

How it usually works

Most Texas land loans and owner-finance notes are secured by a deed of trust, which lets the lender foreclose without going to court. Under the Texas Property Code, the sale is a public auction at the county courthouse between 10 a.m. and 4 p.m. on the first Tuesday of the month, and notice of the sale must be given at least 21 days ahead. If the property is your residence, the lender must first send a notice of default giving you at least 20 days to catch up. Every week counts, so the earlier you act, the more options you have.

  1. Find your dates. Look for a notice of default or a notice of sale in your mail. The notice of sale names the date and county.
  2. Get the payoff amount. Ask your lender or note holder for a written payoff figure, including late fees.
  3. Get a written offer. If our offer covers the payoff, the title company pays the lender directly at closing and you keep the rest.
  4. Close before the sale date. Tell us your sale date up front so we can tell you right away whether we can close in time.

Questions

Common questions

Can you stop my foreclosure?

No. We only offer to buy your land. We don't negotiate with your lender and we can't promise to stop a sale. Talk to your lender, an attorney or a HUD-approved housing counselor about all your options.

When are foreclosure sales held in Texas?

On the first Tuesday of the month, between 10 a.m. and 4 p.m., at the county courthouse. If that Tuesday is January 1 or July 4, the sale moves to the first Wednesday.

How much notice do I get?

Notice of the sale must be given at least 21 days before the sale. If the property is your residence, you must first get a notice of default with at least 20 days to cure.

What if I owe more than the land is worth?

Tell us anyway. We'll give you a straight answer on whether a sale can cover the debt. If it can't, an attorney can explain other options.
