What to know
How it usually works
In Texas, the minerals under a tract can be owned separately from the surface. When they are split off by a deed, that's called a severance, and many families own minerals under land they've never lived on. Water works differently. Under Texas Water Code 36.002, a landowner owns the groundwater under their land as real property, and those rights can be sold with the land or separately. Local groundwater conservation districts can limit how much is pumped and whether it can be moved off the land. Water in rivers and streams is different again: it belongs to the State of Texas, and the right to use it comes from a state permit.
- Find your paperwork. The deed that gave you the minerals or water, any oil and gas lease, division orders and recent royalty check stubs. Whatever you have is fine.
- Tell us the county and the interest. The county, the legal description or abstract, and roughly what share you own.
- Get a written cash offer. We research the title, any production and the local rules, then send a clear offer with no obligation.
- Close at a licensed title company. The interest is conveyed by deed and the title company pays you at closing.
Is a pipeline company asking for an easement across your land? Our affiliated company, National ROW, works for landowners on pipeline easements.
Questions
Common questions
Can I sell my mineral rights and keep my land?
Yes. Texas lets minerals be owned separately from the surface. You can sell all or part of your mineral interest and keep the land, or sell both.
Can I sell my mineral rights if I'm getting royalty checks?
Yes. We look at the lease and the production history to make the offer. Selling ends your right to future royalties on the share you sell, so compare that against the cash before you decide.
Who owns the water under my land in Texas?
Under Texas Water Code 36.002, the landowner owns the groundwater beneath their land as real property. Local groundwater conservation districts can regulate how it's pumped and transported.
Do you buy surface water rights?
Water in rivers and streams belongs to the State of Texas, and use rights come from state permits. Tell us what you have and we'll tell you straight whether we can buy it.
